The Toms River 16-year-old who was run down while trying to cross busy Route 70 not far from his house Monday remains hospitalized with head and internal injuries. Township police say they do not expect to file charges against the driver.

According to authorities, the teen attempted to cross the state highway near Yale Avenue at about 12:40 PM.

He ventured into the path of a Honda Civic driven by Vincent Marsala, 38, of Jackson, police said. The teen was taken by ambulance to Jersey Shore University Medical Center in Neptune.

The investigation is being handled by Toms River PD Traffic Safety Officer Robert Westfall, with members of the Ocean County Prosecutor's Office and the County Sheriff's CSI unit.
