The allegedly intoxicated driver who survived a head-on crash in Holmdel that killed another driver instantly last December faces possible trial for vehicular homicide in Monmouth County.

Robert A. Pennington, 51, of Marlboro, was indicted in Freehold in connection with the collision on Route 34, according to information from the office of acting Monmouth County Prosecutor Chris Gramiccioni. He has been free since posting $100,000 full bail after his arrest.

Siva Kovvuri of Old Bridge's Parlin section was pronounced dead at the scene on December 5. Investigators determined that Pennington's northbound Chrysler minivan veered across the yellow double dividing line near the intersection of East Lawn Drive, directly into the path of the Hyundai Accent driven by Kovvuri.

Despite wearing a seat restraint, Kovvuri suffered signficant head, torso and extremity injuries, authorities said. Investigators contend that Pennington's blood alcohol content, in a sample taken after the crash, registered .258 percent. The legal threshhold in New Jersey is 0.08 percent.

Investigators contend that Pennington had spent several hours prior to the crash drinking in the Fantasies club in Keyport.
