A former Hillsborough resident is indicted by a jury while a former Toms River High School North teacher awaits trial for charges that followed the alleged sexual assault of a 15-year old.

Alan D. Harbatuk, 71, formerly of Hillsborough was found guilty on one count of 2nd degree Sexual Assault for engaging in sexual relations with a 15 year old in 2003 both in Barnegat at the Citta Boy Scout camp and in Hillsborough Township where he resided at the time.

Harbatuk has been remanded to the Ocean County Jail pending sentencing which will be scheduled once an Avenel evaluation is completed.

He faces 5-10 years in New Jersey State Prison with Megan’s Law required registration and Parole Supervision for Life.

Harbatuk was arrested on October 23, 2014 by the Somerset County Prosecutors Office.

The case was transferred to the Ocean County Prosecutor’s Office to be prosecuted together with co-defendant Raymond Waters.

Waters was charged with Aggravated Sexual Assault and Sexual Assault for engaging in sexual relations with the same 15-year old victim while a teacher at Toms River North High School.

His trial will be held at a future date.

The case was tried by Senior Assistant Prosecutor Kristin L. Pressman before the Honorable Therese A. Cunningham, J.S.C.

The case was investigated by Sgt. Jason Steele of the Ocean County Prosecutors Office, Somerset County Prosecutors Office Detective Justin Berger, Hillsborough Police Department Detective Robert Meszaros, as well as, Detective Tom Grosse and retired Detective Alex Scherer of the Toms River Police Department.
