Lacey police responding to a report of a man passed out behind the wheel in the parking lot of JR's Liquors on Lacey Road on Wednesday, December 16, found 38-year-old Brian Nelson of Toms River inside the vehicle, according to authorities.

Nelson was arrested, had his vehicle impounded under John's Law and was charged with DUI, Reckless Driving, and Refusal to Submit Breath Samples, police said.

Three days later, on Saturday, December 19, Lacey officers received a report of an aggressive driver who had pulled into the parking lot of JR's Liquors. When cops arrived, they found Nelson passing out behind the wheel again. He was charged with the same counts as the first incident, as well as having an Open Container of Alcohol in a Motor Vehicle.

Authorities said efforts were taken to keep Nelson's car for longer than 12-hours since it was his second DUI arrest within three days, but under current law, they had to give it back to him.
