In a video posted to social media, it seems that Seaside Heights police officers get into a slight confrontation with some people who were smoking medicinal marijuana on the Seaside Heights Boardwalk.

The video, that was posted publically to Facebook on Saturday, depicts a man and a woman smoking weed on the boardwalk, now they did have their cards and paperwork to show that it was in fact for medical use.

The folks in the video claim that they are allowed to smoke in that area because it's purely for a medicinal purpose and that according to the law they are allowed to smoke in that area. The Seaside Heights Police Officers argue that because they are in a public area, they are not allowed to smoke the weed and that the smoking area is strictly for tobacco.

Here is the law verbatim:

C.24:6I-8  Inapplicability of act.

The provisions of this act shall not be construed to permit a person to:

  1. operate, navigate, or be in actual physical control of any vehicle, aircraft, railroad train, stationary heavy equipment or vessel while under the influence of marijuana; or
  2. smoke marijuana in a school bus or other form of public transportation, in a private vehicle unless the vehicle is not in operation, on any school grounds, in any correctional facility, at any public park or beach, at any recreation center, or in any place where smoking is prohibited pursuant to N.J.S.2C:33-13.

A person who commits an act as provided in this section shall be subject to such penalties as are provided by law.

I have to admit that I am very confused on who is right in this situation. What do you think? Where the police officers right or the couple?
