Peeping pastor spent years looking up employee’s skirt, NJ police say

HACKETTSTOWN — A Lutheran pastor who police said spent years using cameras to look up an employee’s skirt turned himself in on Thursday, more than a year after the woman first made the allegations against him.

Terry Herzberg, 66, was arrested after police were notified by a woman that he had been taking inappropriate pictures of her while she was at work.

After a search warrant was executed at the Gethsemane Lutheran Church and Herzberg’s residence, police determined he had tried to take pictures of the woman from under her desk while she was sitting during incidents between November 2013 and June 2016.

Police say he had also taken video up the woman’s skirt while she was sitting and standing during incidents between July 2015 and June 2016.

According to a story in the Daily Record, the woman, who had worked as an administrative assistant at the church, filed a lawsuit against the church and Herzberg last year. The story also said Herzberg “accelerated” his retirement plans after the initial claims were made last June.

In the lawsuit, the woman claimed the church had violated state laws against discrimination, and that Herzberg “created an intimidating, hostile, or offensive working environment.” Some examples the Daily Record cited from the lawsuit include Herzberg making comments about her clothing, and giving her a card that said she was “sexy.”

According to court records, the lawsuit is ongoing. After-hours messages left for attorneys listed for both parties in the lawsuit  were not immediately returned Thursday evening.

In the criminal matter, Herzberg has been charged with third-degree invasion of privacy and third-degree criminal attempt invasion of privacy. He was being held pending a first court appearance.
