A Bergen County McDonald's is being sued by a Florida man over a cup of hot coffee.

Francisco Rafael Borbolla,54, of Homestead, Florida says in his suit that he went to the River Edge restaurant in August, 2011 and got second degree burns when he spilled the coffee on himself because the lid was not tight on the cup according to the Bergen Record.

The suit seeks unspecified compensatory and punitive damages. Borbolla's attorney Rosemarie Arnold defends the suit filed in Hackensack Superior Court and says it is not frivilous.
“This is a serious case involving lack of due care on the part of McDonald’s,” attorney Rosemarie Arnold told the newspaper. “If the naysayers saw the burns on my client’s genitals, they would be speechless.”
