Justices opted not to hear three petitions for certification filed by businessman Michael Perlmutter regarding lower-court and appellate rulings involving the Toms River Planning Board, Manchester Planning Board and Township Council, and developer Jaylin Holdings.

Arguments involved zoning interpretations, variances, permitted uses, a related ordinance, and land-use impacts of decisions by the New Jersey Department of Environmental Protection (DEP).

Sources with knowledge of the proceedings confide that the high court decision clears much of the litigation-riddled path that has kept the project in limbo for more than a decade.
