Toms River officials are reportedly taking a wait-and-see approach before using eminent domain to gain beach easement rights for the U.S. Army Corps dune replenishment project. According to Patch.com, they're waiting to hear the results of an appeal filed by Harvey Cedars officials in State Supreme Court regarding to a case that awarded beach front property owners $375-thousand dollars for a dune project that obstructed their ocean front view. Toms River Mayor Tom Keleher expresses concern about the potential for costly legal action if they use eminent domain.
