The man fatally shot by Beachwood Police outside the High Velocity Bar and Grill this summer had a blood alcohol level above the legal limit. According to BerkeleyPatch.com the findings were recently released by the Ocean County Prosecutors office showing 52-year-old Mark Tanouye's blood alcohol level of .092. The legal limit is .08. Tanouye was shot after allegedly ignoring police orders to drop the handgun he was carrying the the bar's parking lot.

The Shooting was being investigated by the Ocean County Prosecutors Office that ruled in September that the actions taken by the officer were justified .
